Disputed election results: Supreme Court grants NDC lawyers’ application for substituted service including WhatsApp

The Supreme Court has granted an application for substituted service by lawyers of NDC Parliamentary candidates for Techiman South, Okaikwei Central, Tema Central and Ablekuma North constituencies.

The party earlier filed an application to quash the High Court decision which ordered the EC to collate and declare results of the 4 constituencies.

Lawyers of the NDC parliamentary candidates led by Seth Nyaaba disclosed to the court on Thursday, February 6, 2025, that efforts to serve the court documents on the NPP candidates had proven futile and would require substituted service to serve the documents.

“More than three unsuccessful attempts have been made to effect personal service of the certiorari application, and the supplementary affidavit in support of the certiorari application in support on the 2nd to 5th Interested Parties.

“Any further attempt to serve the 2nd to 5th Interested Parties with another hearing notice for the hearing of the Certiorari application may be practically impossible due to the experiences gathered from the service of the hearing notice for the 23rd January 2025 hearing.

“It is impracticable to serve personally the certiorari application on the 2nd to 5th Interested Parties, especially 2nd, 4th and 5th Interested Parties who are currently in Parliament as the purported Members of Parliament for the constituencies in contention.

They therefore prayed the court to grant their application to prevent further delay to the case.

Justice Henry Kwofie serving as the sole judge in the matter granted the application indicating that the service should be done by posting copies of the certiorari application, the supplementary affidavit in support of the certiorari application and the hearing notice on the notice board of the Supreme Court, the residences of the defendants, the legal department of the Office of Parliament and via the WhatsApp.
